Under the county Rural Zoning Resolution, a fence between residential lots must be of approved material and kept in good repair. Pools require a fence at least 48 inches high with a self-closing, lockable gate. Cities set their own standards.
For townships zoned by the Butler County Rural Zoning Resolution, Section 24.733 requires a fence between lots in an R-District, recorded residential subdivision, or any residential lot to be of approved material and kept in good repair and appearance. Barbed wire and electrical fences are barred in residential areas. Section 24.734 requires an in-ground pool (or its property) to be walled or fenced with approved material at least 48 inches high, with a self-closing gate and lock. Incorporated cities and self-zoning townships enforce their own fence and pool-barrier codes.
Non-conforming fences are zoning violations under 25.51: misdemeanor, up to $500 per day, each day a separate offense.
