Fence heights fall under the Charlotte County Zoning Code, Section 3-9-72. In every residential district except Residential Estate, a side or rear fence up to six feet may sit behind the front setback line. Within the front setback, a solid opaque fence is limited to three feet and an open nonopaque fence to four feet. Residential Estate lots and nonresidential districts allow up to eight feet on the lot line. Height is measured from finished grade, excluding berms, and anything over six feet must keep the district setback. Port Charlotte and Punta Gorda Isles deed restrictions and HOAs often cap fences lower.
