Queens fences 6 ft or less around 1-2 family homes generally need no DOB permit, but fences over 6 ft, commercial fences, and pool barriers do. All must comply with NYC Zoning Resolution yard rules.
Fence construction in Queens is regulated by the NYC Department of Buildings (DOB) under the NYC Building Code and the NYC Zoning Resolution. Residential fences 6 feet tall or less that enclose 1-2 family dwellings generally qualify as minor work and do not require a DOB permit, but they must still comply with zoning yard regulations. Any fence exceeding 6 feet in height, any fence on a zoning lot with a commercial or multifamily use, and any pool enclosure fence requires a DOB work permit filed by a licensed professional. Zoning Resolution Section 23-44 governs fence height in residential districts: front yard fences are generally limited to 4 feet in R1 through R5 districts (which cover most of Eastern Queens neighborhoods like Bayside, Douglaston, Little Neck, Howard Beach, and Whitestone), while side and rear yard fences may reach 6 feet. Corner lots have additional sight-triangle restrictions. Fences in historic districts (Douglaston Historic District, Jackson Heights Historic District) require additional Landmarks Preservation Commission approval before any DOB permit is issued. Chain-link, wood, vinyl, and wrought iron are all acceptable materials in most residential districts.
Building without a required DOB permit: Class 2 violation with civil penalty of $2,500 minimum, plus double filing fees. Work without permit stop-work orders are commonly issued. Unpermitted fences may be ordered removed at owner expense.
