Massachusetts pool barrier requirements are set statewide under 780 CMR (MA Building Code, Appendix G) and 105 CMR 435 (Semi-Public/Public Pools). Residential pool barriers: minimum 48 inches high, gate self-closing and self-latching with latch at least 54 inches above grade, openings shall not allow passage of a 4-inch sphere (lower openings 1-3/4 inch). Pool cover (ASTM F1346-compliant) may supplement but cannot replace barrier. Above-ground pools with sides 48+ inches high qualify if ladder is removable/lockable. A door from house to pool area must have an alarm or self-closing mechanism. Building permits required for all pools including above-ground (usually over 24 inches deep). Quincy (Inspectional Services), Brookline (Building Dept.), and Weymouth (Building Dept.) enforce. Draining water into storm drains restricted under MS4 permits.
Non-compliant barrier: immediate correction, pool closed until compliant. Fines up to $1,000 under 780 CMR local enforcement. Unpermitted pool installation: $300/day. Civil liability exposure if drowning occurs.
