Kentucky's residential swimming pool barrier requirements derive from the state-adopted International Residential Code. Local jurisdictions may not weaken the four-foot barrier and self-closing gate standards.
Kentucky has adopted the Kentucky Residential Code based on the International Residential Code (IRC), which contains Appendix G governing pool, spa, and hot tub barriers. Pools deeper than 24 inches must be enclosed by a barrier at least 48 inches high with no openings allowing passage of a 4-inch sphere. Gates must be self-closing and self-latching, opening outward from the pool. The Department of Housing, Buildings and Construction enforces the code statewide; local building departments administer it but cannot adopt less stringent rules under KRS 198B.050.
Building permit denial, stop-work orders, and civil liability for drownings on noncompliant pools.
