Pool barriers in El Paso must be at least 48 inches tall measured from the outside ground. Openings cannot allow passage of a 4-inch sphere. Gates must be self-closing and self-latching with the latch at least 54 inches above the ground, and must swing outward from the pool. If the house wall forms part of the barrier, doors opening to the pool area must be alarmed or have a power safety cover. Texas Health and Safety Code Chapter 757 adds state-level pool barrier requirements. The El Paso Fire Marshal and Development Services inspect residential pool barriers at final construction inspection.
Barrier violation: up to $2,000 per the pool safety code plus required corrective action. Civil liability if a drowning occurs because of a non-compliant barrier.
