The Stille-DeRossett-Hale Single State Construction Code Act (MCL 125.1501 et seq.) establishes a uniform statewide construction code that municipalities cannot weaken or substantively modify. Under the adopted Michigan Residential Code, residential swimming pools, spas, and hot tubs deeper than 24 inches require a barrier at least 48 inches high with self-closing, self-latching gates opening outward. Openings cannot allow passage of a 4-inch sphere, and above-ground pools must have removable or lockable ladders. The code applies to all one- and two-family dwellings statewide.
Local building officials may issue stop-work orders, withhold certificates of occupancy, and impose civil fines under MCL 125.1523 for noncompliant pool installations.
