Every residential pool, spa, and hot tub with water deeper than 24 inches requires a permanent barrier at least 48 inches tall measured from the exterior grade. Vertical gaps must prevent a 4-inch sphere from passing; horizontal chain-link opening maximum is 1.75 inches. Bottom gap: 2 inches or less. Gates must open away from the pool, be self-closing and self-latching, with the release mechanism at least 54 inches above grade. Many Hudson County municipalities (Jersey City, Hoboken, Union City) amend up to a 5-foot minimum and require a separate construction permit for the barrier itself. Pools accessible through a house door must have door alarms or an isolating barrier. Above-ground pools with 48-inch or higher sides and removable ladders can serve as their own barrier. Annual inspection is triggered at Certificate of Compliance renewal in some towns.
Non-compliant barrier: pool cannot be filled or used until corrected; immediate stop-use order from construction official. Fines $250-$2,000 per violation under the NJ UCC. A drowning or injury while barriers are non-compliant creates substantial civil and potential criminal exposure. Operating without a pool permit: additional penalty fees.
