Every residential pool in Oneida County must be enclosed by a barrier at least 48 inches tall under NY Residential Code Appendix G, effective statewide May 2020. Gates must be self-closing and self-latching with latches on the pool side at least 40 inches above grade, and the bottom gap cannot exceed 2 inches. Chain-link mesh openings cap at 2.25 inches (or 1.75 with slats). Pools built or substantially modified after December 14, 2006 also require an ASTM F2208-compliant pool alarm under NY Executive Law 387(14) and 19 NYCRR 1228.2. During construction, a temporary 48-inch barrier is required and must be replaced by the permanent fence within 90 days. Utica and Rome building departments inspect before water is added.
Pool barrier violations can result in fines up to $5,000 and/or 15 days jail per day of violation. Pool alarm signage violations: $500 first offense, $1,000 subsequent.
