Mississippi has adopted the International Residential Code (IRC) Appendix G and International Swimming Pool and Spa Code (ISPSC) addressing pool barriers. Hinds County and Jackson require barriers around all residential swimming pools, spas, and hot tubs with water depth exceeding 24 inches. Minimum barrier height is 48 inches measured from outside the barrier. Gates must open outward from the pool and be self-closing and self-latching, with latch at least 54 inches above grade (or on the pool side under certain conditions). Fence openings must not allow passage of a 4-inch sphere (1.75-inch for chain-link without slats). House walls may serve as part of the barrier if doors to the pool area have alarms or self-closing mechanisms. Above-ground pools with 48-inch vertical sides may satisfy barriers if ladders are removable or locked. Pool covers supplement but do not replace physical barriers. Inspection required at building permit final.
Non-compliant barrier: immediate correction, pool use prohibited. Fines $100-$500 per day. Liability exposure for drowning incidents including potential negligence lawsuits. Homeowner insurance may deny claims on unpermitted pools.
