Duval County, under the consolidated Jacksonville government, allows recreational backyard fires subject to conditions derived from Ch. 366 (Fire Prevention Code) and the adopted Florida Fire Prevention Code. Fires must be contained in a non-combustible fire pit, chiminea, or manufactured outdoor fireplace. Maximum burn area is generally 3 feet in diameter. All fires must be constantly attended by an adult with extinguishing equipment immediately available (garden hose or fire extinguisher). Setback of at least 15 feet from any structure, fence, or property line is standard practice per fire prevention guidelines. Only clean, dry firewood or manufactured fire logs may be burned. Burning of leaves, yard waste, garbage, or treated lumber in backyard fires is prohibited. During drought conditions or air quality advisories, the Jacksonville Fire Marshal may issue burn restrictions that include recreational fires. HOA rules in many Duval County neighborhoods add additional restrictions on fire pit placement and operating hours. Smoke must not create a nuisance to neighbors under Ch. 368 noise and nuisance provisions.
