Small recreational backyard fires for cooking or warmth are allowed in most Onondaga County towns outside the spring burn ban. Fire must be attended and under 3 ft wide.
Small recreational backyard fires are permitted in Onondaga County outside the NY DEC statewide brush-burn ban (March 16 - May 14). Per 6 NYCRR Part 215, allowed fires are limited to cooking and warmth, must use clean dry wood or charcoal, contained in a pit or device under 3 ft diameter and 2 ft high, attended at all times, and extinguished before leaving. Burning trash, leaves, construction debris, and treated wood is prohibited year-round statewide. Syracuse Fire Code restricts open burning within city limits with additional setback requirements. Permitted cooking grills and manufactured chimineas are generally exempt.
DEC burn ban violation: minimum $500 first offense, up to $10,000 subsequent. Syracuse Fire Code: up to $500 plus cost of response.
