The enforceable tool is nuisance abatement: Health & Safety Code Chapter 343 lets a county require owners to clear rubbish, brush, and overgrown weeds that create a public health or fire nuisance in unincorporated areas, after notice. On-site burning of cleared brush is allowed only under the TCEQ exceptions in 30 TAC 111.209 and never during an active burn ban. Cities within the county (Brownsville, Harlingen, South Padre Island) may adopt their own vegetation-clearance ordinances.
Failure to abate a declared vegetation nuisance under H&S Ch. 343 can lead to county abatement with costs assessed as a lien against the property, plus fines.
