Live Oak requires property owners to keep lots free of tall weeds, brush, and combustible vegetation that create fire or health hazards. Grass and weeds over 12 inches and dry brush near structures must be abated.
Live Oak Code of Ordinances Chapter 7 (Health and Sanitation) and Chapter 9 (Fire Prevention) require property owners to maintain premises free of accumulated brush, weeds, and combustible vegetation that could fuel a fire or create a public nuisance. The city applies a maximum grass and weed height standard of 12 inches under its nuisance vegetation ordinance. Defensible space principles require clearing dry brush, leaf litter, and dead vegetation within a reasonable distance of structures, fences, and property lines. Vacant lots must be mowed and brush cleared at least twice per year or as directed by Code Enforcement. Although Live Oak is not in a wildland-urban interface with federal mapping, live oak trees and cedar in the region carry real wildfire risk in drought months, and the city works with Live Oak Fire Department on hazard mitigation. Notice of violation is typically issued before abatement, giving the owner 7 to 10 days to cure.
Failure to abate after notice allows the city to perform the work and assess costs plus an administrative fee as a lien on the property under Texas Health and Safety Code Chapter 342. Citations carry Municipal Court fines up to 500 dollars per offense, with each day a separate violation.
