O.C.G.A. 10-1-260 through 10-1-270 (the Liquefied Petroleum Safety Act) gives the Georgia Safety Fire Commissioner exclusive authority to regulate LP gas storage and handling. Rules adopt NFPA 58 standards uniformly statewide. Residential tanks 125 gallons or less must be set back at least 5 feet from buildings and property lines; tanks 125-500 gallons require 10 feet; 500-2000 gallon tanks need 25 feet. Only licensed dealers may install, fill, or service tanks. Local governments may not impose conflicting setback or storage requirements.
Operating without a license, improper installation, or unsafe storage results in fines up to $5,000 per violation under O.C.G.A. 10-1-268, plus possible criminal charges for repeat or willful violations.
