Under K.S.A. 55-1801 et seq. and K.A.R. 22-9-1 through 22-9-5, the Kansas State Fire Marshal regulates LP-gas storage, transportation, and dispensing by adopting the latest National Fire Protection Association 58 (Liquefied Petroleum Gas Code). The Kansas LP-Gas Safety Act requires licensure of dealers, installers, and transporters, plus mandatory container distance setbacks based on water capacity. The State Fire Marshal investigates complaints and inspects bulk plants. Local fire codes may add inspection processes but cannot conflict with statewide LP-Gas standards or licensing requirements.
Operating without a Kansas LP-Gas license, bypassing setbacks, or failing inspection can lead to license suspension, civil penalties up to $5,000 per violation, and criminal charges for repeated violations.
