Duluth has no city-specific smoke detector ordinance and defers to Georgia state law. O.C.G.A. § 25-2-40 requires an approved smoke detector in every dwelling, with hard-wired listed detectors in homes built on or after July 1, 1987 and at minimum battery-operated units in older homes. Short-term rentals must additionally show proof of installed smoke detectors, CO detectors, and fire extinguishers at permit application.
Chapter 6 (Fire Prevention and Protection) of the Duluth Code of Ordinances adopts the Georgia State Minimum Fire Prevention Code based on the International Fire Code rather than imposing a stricter local smoke-alarm rule. Smoke alarm installation is governed by O.C.G.A. § 25-2-40: every dwelling and every dwelling unit within an apartment, house, condominium, or townhouse must have an approved smoke detector. Homes constructed on or after July 1, 1987 must have a listed smoke detector installed per the manufacturer's specifications, typically hard-wired with battery backup outside each sleeping area, in each bedroom, and on every story including basements (per the 2018 IRC R314 adopted statewide). Existing homes built before that date must have at least an approved battery-operated unit in good working order. Landlords must install, test, and certify operability at the start of each tenancy; tenants are responsible for routine battery replacement. For Duluth STR permits, applicants must specifically submit proof of installed smoke detectors, carbon monoxide detectors, and fire extinguishers as part of the fire/life safety review.
An occupant who fails to maintain a working smoke detector faces a maximum $25 fine under O.C.G.A. § 25-2-40, with a warning required for a first violation. Landlords who fail to provide working alarms can face habitability claims. STR applicants who cannot demonstrate working detectors will have permit applications denied by Duluth Planning and Development.
