Every Illinois home must have working smoke detectors within 15 feet of each sleeping area under the state Smoke Detector Act. St. Clair County's adopted residential code also requires alarms in each bedroom and on every level. As of 2023, new or replacement detectors must have sealed 10-year batteries.
The Illinois Smoke Detector Act requires at least one approved smoke detector on every story of a dwelling and within 15 feet of every room used for sleeping. Since January 1, 2023, when a battery-only detector is replaced or a home lacks hard-wired alarms, the new device must be a self-contained unit with a non-removable 10-year sealed battery. St. Clair County's Building Regulations adopt the 2012 International Residential Code, which independently requires smoke alarms in each sleeping room, outside each sleeping area, and on each additional story. Landlords must supply and maintain detectors; tenants must keep them operational.
Violating the Smoke Detector Act is a petty offense; a first offense carries a fine up to $100 and a second up to $200, after a 30-day warning period.
