Since LB 77 took effect September 2, 2023, any Nebraska resident 21 or older who is not a prohibited person may carry a concealed handgun without a permit. Optional Concealed Handgun Permits remain available under the Concealed Handgun Permit Act for reciprocity.
Neb. Rev. Stat. 69-2441 was amended by LB 77 (2023) to allow permitless concealed carry by adults 21 and older who are not federally or state-prohibited from possessing firearms. The Concealed Handgun Permit Act, Neb. Rev. Stat. 69-2427 to 69-2447, still authorizes the Nebraska State Patrol to issue permits to applicants who pass training, background, and proficiency requirements, mainly to obtain reciprocity in other states. State law preempts local concealed carry ordinances under section 18-1703. Concealed handguns remain prohibited in places listed in section 69-2441, including police stations, detention facilities, courtrooms, polling places, schools, professional or college sporting events, places of worship that opt out, financial institutions, and posted private property.
Carrying a concealed handgun in a prohibited place or by a prohibited person is generally a Class I misdemeanor for a first offense and a Class IV felony for repeat offenses, with jail time and fines.
