Maine condo associations enforce the declaration, bylaws, and rules through fines and liens under the Condominium Act. Non-condo HOAs enforce covenants and architectural rules through the recorded declaration interpreted under contract and property law — Maine has no general HOA enforcement statute.
For condominiums, 33 M.R.S. § 1603-102(a)(1) lets an association "[a]dopt and amend bylaws and rules and regulations," and § 1603-102(a)(11) lets it levy reasonable fines, after notice and a hearing, for "violations of the declaration, bylaws and rules and regulations." Unpaid charges become a lien under § 1603-116. For non-condo planned communities, Maine has not adopted the Uniform Common Interest Ownership Act; restrictive covenants, architectural-review provisions, and CC&Rs are enforced as recorded equitable servitudes under Maine property and contract law, with the association acting under Title 13-B. Courts construe ambiguous covenants in favor of the free use of land, so vague architectural restrictions can be hard to enforce.
