Arizona provides several dispute resolution mechanisms for HOA conflicts. The Arizona Department of Real Estate (ADRE) accepts complaints against HOAs for violations of the Planned Communities Act or Condominium Act and may conduct administrative hearings. Under ARS 33-1803.01, members may petition the board on any matter, and the board must respond within 60 days. ARS 12-133 allows courts to order pre-trial mediation for HOA disputes. Before imposing a fine, the HOA must give written notice of the alleged violation and provide an opportunity to be heard at a board meeting. The HOA must adopt and distribute a fine schedule approved by the membership. Many CC&Rs include mandatory arbitration clauses, which Arizona courts generally enforce.
