The Maine Condominium Act expressly lets associations levy fines, but only after due process. Under 33 M.R.S. § 1603-102(a)(11) a condo association may impose late charges and, after notice and a hearing, levy reasonable fines. Non-condo HOAs draw fine power from their declaration.
Section 1603-102(a)(11) authorizes a condominium association to "[i]mpose charges for late payment of assessments and, after notice and an opportunity to be heard, levy reasonable fines for violations of the declaration, bylaws and rules and regulations of the association." The statute caps fines only by the word "reasonable" — there is no fixed dollar limit — and conditions them on advance notice plus a hearing. Under § 1603-116, unpaid fines become enforceable as part of the assessment lien. Maine has no general non-condo HOA fining statute, so a planned-community HOA's fine power and any procedures come from its recorded declaration and Title 13-B nonprofit governance.
