Hayward has no municipal ordinance limiting holiday lights on private residential property. Restrictions come from HOA architectural rules under the California Davis-Stirling Act (Cal. Civ. Code 4000-6150). Holiday lights are exempt from HMC Chapter 10 sign provisions. Lights creating sustained nuisance can be cited under HMC Chapter 4 Article 1.
Hayward Municipal Code does not regulate the timing, intensity, or duration of holiday lights on private homes. HMC Chapter 10 sign provisions exempt temporary holiday and seasonal displays, and Hayward does not have a comprehensive residential outdoor lighting ordinance regulating decorative lighting. For Hayward's planned communities and condominium HOAs (Stonebrae Country Club, Cannery Place, Eden Shores, Glen Eden, and other master-planned and condo associations), the California Davis-Stirling Common Interest Development Act (Cal. Civ. Code 4000-6150) governs and the HOA's CC&Rs typically regulate holiday displays. Typical Hayward HOA rules allow holiday lights from the Friday before Thanksgiving through January 15, prohibit lights left up year-round, limit roof-mounted spotlights and laser projectors, and may restrict synchronized music or animated displays. California Civil Code 4710 protects 'noncommercial signs, posters, flags, or banners' but that protection does not extend to electric holiday lights. Civil Code 4715 protects religious items displayed on entry doors and door frames. Lights that shine continuously into a neighbor's bedroom window can be cited as a public nuisance under HMC Chapter 4 Article 1 (Public Nuisances) or pursued as a private nuisance under California Civil Code 3479. Lights or wiring not meeting the California Electrical Code adopted under HMC Chapter 9 can be cited as a fire hazard.
There are no Hayward fines for residential holiday lights themselves. Sustained light trespass causing demonstrable harm can be cited under HMC Chapter 4 Article 1 (Public Nuisances) with administrative citations under HMC 1-7 starting at $100. HOA violations are enforced by the HOA, capped at $100 per violation under California Civil Code 5850 unless the board makes a written health/safety finding.
