Fayetteville has no city ordinance restricting lawn ornaments on residential property. Chapter 22 (Property Maintenance/Minimum Housing) requires reasonable upkeep and could apply if ornaments create blight or pest conditions. UDO 30 accessory-structure rules apply if an ornament becomes a structure. Historic Resources Commission review applies in historic districts. HOA covenants under NCGS 47F commonly regulate ornaments. NCGS 47F-3-121 protects flags.
Fayetteville Code of Ordinances does not regulate the content or placement of lawn ornaments, statuary, religious displays, flags, or similar decorative items. Chapter 22 (Property Maintenance Code) and minimum housing rules require reasonable maintenance and could theoretically apply if ornaments are abandoned to the point of creating blight, harboring pests, or impeding emergency access; ornaments themselves are not prohibited. UDO Chapter 30 accessory-structure setback rules may apply if a freestanding ornament functionally becomes a structure (large statuary on a foundation, decorative shed). Real restrictions on lawn ornaments come from three sources: (1) Historic Resources Commission (HRC) review under UDO 30-5.E in Haymount, Downtown, and Liberty Point Local Historic Districts for permanent or visible installations; (2) HOA and condominium covenants under NCGS 47F (Planned Community Act) and 47C (Condominium Act); (3) deed restrictions in older planned subdivisions and newer master-planned communities (King's Grant, Westgate, Cypress Lakes, planned communities near Fort Liberty). Typical HOA rules: architectural review committee approval; size limits 3-4 feet; rear or side yard placement preference; restrictions on plastic flamingos and yard art. Federal Fair Housing Act protects religious displays. NCGS 47F-3-121 expressly protects the U.S. flag from HOA bans (must allow reasonable display).
No municipal enforcement against ornaments under Chapter 22 unless creating a maintenance nuisance or accessibility issue. HRC historic district violations may require removal at owner expense plus civil penalties up to $500 per day under UDO 30-5.J. HOA and condo violations follow declaration-specified fine schedules ($50-$500), escalating to liens under NCGS 47F-3-116. Religious display restrictions may trigger federal Fair Housing Act review. Flag restrictions may be void under NCGS 47F-3-121.
