The Michigan Zoning Enabling Act (MCL 125.3206) requires that a state-licensed family day care home for 1 to 6 minor children be permitted as a residential use in residential zones — cities and townships cannot zone it out. Running a group day care home without local conditional-use approval, or violating the separation or hour limits, is a zoning violation; operating any child care without a state license is separately enforceable by the state.
