The Michigan Zoning Enabling Act (MCL 125.3206) requires that a state-licensed family day care home for 1 to 6 minor children be permitted as a residential use in residential zones β cities and townships cannot zone it out. Holland Charter Township Zoning Ordinance Section 9.5 requires such a home to be at least 1,500 feet from another licensed group day care home (and certain other facilities), have Planning-Commission-approved fencing for child safety, and limits operation to 16 hours in any 24-hour period. State licensing is through the Michigan Department of Lifelong Education (LARA/MiLEAP).
Running a group day care home without local conditional-use approval, or violating the separation or hour limits, is a zoning violation; operating any child care without a state license is separately enforceable by the state.
