Massachusetts protects home daycare. No Essex County town can zone out a family child care home or make you get a special permit for it. You need a state EEC license, not a zoning variance, to care for children at home.
MGL c.40A §3 removes home daycare from the reach of local zoning. A family child care home — up to six children — and a large family child care home are allowable uses by right in every Essex community, and no bylaw can prohibit or require a special permit for them. Towns still apply reasonable rules on setbacks, parking, and yard size. Licensing runs through the state Department of Early Education and Care, which sets ratios, safety, and background-check requirements. Salem, Lynn, and the rest cannot override that state protection.
A town that denies or specially conditions a home daycare violates c.40A §3, and the operator can appeal and prevail. Running a home daycare without an EEC license brings state enforcement and closure.
