Home daycare is regulated by the State of New Jersey, not Passaic County. A family child care home caring for three to five children must register under N.J.A.C. 3A:54 (Family Day Care Provider Registration Act). Registration is processed through the county Child Care Resource and Referral agency.
New Jersey licenses and registers child care at the state level; Passaic County has no separate daycare ordinance. A 'family child care home' is a private residence serving no fewer than three and no more than five children at any one time for at least 15 hours per week; these register under N.J.A.C. 3A:54 pursuant to the Family Day Care Provider Registration Act, N.J.S.A. 30:5B-16 et seq. Applications go to the county's Child Care Resource and Referral agency and require character references, a medical exam and TB test, CARI child-abuse background checks for household members 14+, and pre-service training. Larger centers are licensed under N.J.A.C. 3A:52. Municipal zoning may still apply to home daycares.
