Oklahoma Department of Human Services Child Care Services licenses home-based daycares under Title 10 §402 and Oklahoma Administrative Code 340:110. Two tiers: (1) Family Child Care Home — up to 7 children including provider's own under age 6, with no more than 2 under 24 months; (2) Large Family Child Care Home — up to 12 children with a qualified assistant, no more than 4 under 24 months. Licensing requirements: background check (OSBI, FBI, child abuse registry), TB test, minimum 20 hours pre-service training, CPR/first aid certification, annual 12 hours continuing education, safe sleep training, medication administration training. Home must meet physical requirements: 35 sq ft indoor space per child, 75 sq ft outdoor play area per child (fenced), working smoke detectors, fire extinguisher, emergency exits, water-heater max 120°F, locked medications/cleaning supplies. Vehicles used for transport require commercial insurance. Liability insurance strongly recommended ($300,000 minimum, $1M preferred). Tulsa County Zoning Title 42 §90.080 allows family daycare as a home occupation by right; large family daycare may require conditional use permit depending on district. Tulsa city ordinance Title 51 §90.050 has similar framework. DHS inspects unannounced at least annually; complaints trigger additional visits. 1-Star through 3-Star Reaching for the Stars quality rating is voluntary.
