Whether a home occupation permit is required is a municipal decision in New Jersey, not a Burlington County one. Under the Municipal Land Use Law, some towns permit home occupations by right, others require a zoning permit, home-occupation permit, or use variance. Apply through your municipal zoning office.
New Jersey counties do not administer home-occupation permits; municipalities do, under the MLUL (N.J.S.A. 40:55D). Depending on your town, a home occupation may be a permitted accessory use requiring only a zoning permit, may need a specific home-occupation permit, or may require a variance from the zoning board. Common municipal conditions cap the business to a percentage of the dwelling's floor area, limit or bar non-resident employees, restrict client visits and parking, and prohibit outdoor storage or visible commercial activity. The Burlington County Planning Board's authority is limited to county-road and drainage site-plan review under N.J.S.A. 40:27.
Operating without a required municipal home-occupation permit, or beyond its conditions, can result in zoning citations, daily fines set by ordinance, and orders to stop the use.
