Indianapolis does not require a discretionary home-occupation permit; a home occupation is allowed by right as an accessory use if it meets every standard in Section 743-306.K. Operations may not run between 10:00 p.m. and 7:00 a.m. and must comply with the performance standards in Section 740-401.B. A use that cannot meet the standards needs a variance from the Board of Zoning Appeals.
Under the Zoning Ordinance, a home occupation is a permitted accessory use in dwelling districts (Section 743-306.K) and does not require a separate use permit so long as it satisfies all of the use-specific standards. Section 743-306.K.17 provides that 'Permitted home occupations shall not operate between 10:00 p.m. and 7:00 a.m.,' and Section 743-306.K.18 requires compliance 'with all performance standards set forth in Section 740-401.B' (the general performance standards covering noise, odor, vibration, and similar impacts). The business must not interfere with local radio, television, or wireless internet (K.12) and must not interfere with the reasonable use and enjoyment of adjacent residential properties, including through its hours of operation (K.13). Where construction or a structure is involved, improvements are processed by the Department of Business and Neighborhood Services (DBNS) through the City's permit system, and a home occupation that cannot meet the Section 743-306.K standards (for example, exceeding the area cap or operating a prohibited activity) requires a variance of use or development standards from the Metropolitan Board of Zoning Appeals. State business registration with the Indiana Secretary of State and applicable state tax registration apply separately to the business entity itself.
Operating outside permitted hours, failing the Section 740-401.B performance standards, or running a home occupation that does not meet Section 743-306.K without a variance is a zoning violation. DBNS Code Enforcement may issue a notice of violation, order the use to cease, and seek continuing-violation penalties under the Revised Code of the Consolidated City and County.
