A home occupation in Indianapolis may not regularly attract more than 4 individuals onto the premises simultaneously for business reasons, and may not generate significantly more traffic than normal for the residential area. Only residents of the dwelling plus up to 2 nonresident assistants (capped at 45 hours per week each) may work in the business.
Customer and helper limits are set in Section 743-306.K of the Zoning Ordinance. Subsection 9 provides that the home occupation 'shall not regularly attract more than 4 individuals simultaneously onto the premises for reasons related to the home occupation and shall not generate significantly greater traffic volume than would normally be expected in the residential area in which the home occupation is conducted.' No off-street parking or loading beyond what the dwelling district already requires is permitted, no minimum required yard may be used for parking or loading, and no additional driveway may be added for the business (subsection 8). On staffing, subsection 15 permits work in the home occupation only by individuals who meet the operator's residence requirements and by up to 2 nonresident assistants; each nonresident assistant's activity is limited to 45 hours per week, and if more than one home occupation is conducted in the same dwelling unit, only one of them may use nonresident assistance. No one in addition to the operator may participate from a secondary dwelling unit (subsection 14). The business must not interfere with the reasonable use and enjoyment of adjacent residential properties (subsection 13).
Drawing more than 4 simultaneous business visitors, generating excess traffic, adding driveways or off-street parking, or using more than 2 nonresident assistants violates Section 743-306.K and is enforced by DBNS Code Enforcement through a notice of violation and continuing-violation penalties under the Revised Code of the Consolidated City and County.
