Unincorporated Marin County does not require a discretionary home-occupation permit. A residential home occupation is an allowed accessory use in every residential district provided the operator obtains and posts a County business license under Chapter 5.54 and complies with the operating standards of Development Code Section 22.32.100.
Under Marin County Development Code § 22.32.100(A), a 'business license shall be obtained/posted in compliance with Title 5, Chapter 5.54 (Business Licenses) of the County Code for home occupations, which are allowed as accessory uses in all residential zoning districts. Home occupations shall comply with all health, sanitary, and fire codes.' The County also offers a voluntary Home Occupation Zoning Verification form through the Community Development Agency Planning Division so an operator can confirm that a particular activity meets the § 22.32.100 standards before commencing business. If the proposed activity exceeds the home-occupation standards (for example, more than one nonresident employee), a Conditional Use Permit under Chapter 22.48 is required instead, and certain handcraft/light-manufacturing activities are reviewed as a 'cottage industry' Use Permit under § 22.32.060.
Operating a home business without the required Title 5 business license, or in violation of the § 22.32.100 operating standards, may be enforced under Title 22 (Development Code) and Title 1 (General Provisions). The County may issue notices of violation, administrative citations, and abatement orders; non-compliant operations may also be ordered to cease until a Conditional Use Permit is obtained.
