Napa County Code (NCC) section 18.104.090(K) requires an administrative permit under Chapter 18.126 before any home occupation may be conducted in the unincorporated county. The application is processed by Planning, Building and Environmental Services (PBES) and includes site plan, floor plan, CUPA hazardous-materials disclosure, and fee.
Under NCC 18.104.090(K), 'No home occupation shall be allowed unless an administrative permit has first been issued for such use pursuant to Chapter 18.126.' The PBES Home Occupation Permit Application Packet (Updated 10/23/2013) specifies the items required for a complete submittal: a completed application signed by owner and applicant; a detailed narrative describing the business, product or service, and on-site activities; the Permit Application Supplemental Information Sheet (use, days/hours of operation, business-related visitors and deliveries, hazardous materials); the Environmental Management CUPA - Related Business Activities Form; a to-scale site plan and a to-scale floor plan of the entire dwelling (each with one 8.5" by 11" black-line reduction), with office space marked; and a check for the application fee made out to the County of Napa. The Administrative Permit decision is made by the director under Chapter 18.126. Following the decision there is a 10 working-day appeal period; any County department, the applicant, or project opponents may appeal to the Board of Supervisors by filing a written appeal and paying the appeal fee, after which a public hearing is set within 90 days.
Operating a home business in unincorporated Napa County without an issued Home Occupation Permit, or in a manner inconsistent with the issued permit, is a zoning violation under Title 18. Enforcement is handled by the Code Compliance Division and can include notices of violation, administrative citations, abatement orders, and revocation of the permit. PBES also retains the right of access to inspect the property under the signed permit application authorization.
