Winter Haven Code Section 21-211 (Chapter 21 ULDC Article III Division 10) regulates home occupations as permitted-by-right uses in residential zoning, subject to standards on location, dwelling modification, nuisance, display/sale, signage, employees, equipment, and traffic. Under Sec. 21-211, home occupations in Winter Haven must: (1) be conducted entirely within the dwelling and use no more than 25% of the floor area; (2) cause no visible change to the residential character of the home (no separate entrance, no exterior storage); (3) generate no noise, vibration, smoke, odor, or electrical interference detectable beyond the lot line; (4) display no goods for sale on the premises; (5) have no on-site sign (with limited exceptions); (6) employ no non-resident workers; (7) use only ordinary household equipment; and (8) generate no traffic substantially in excess of normal residential traffic. All home businesses must also obtain a Business Tax Receipt (BTR) from the Building Division (Sec. 9). Common allowed home occupations: writers, accountants, tutors, online retail (no inventory pickup), consultants. Disallowed: auto repair, salons with walk-in clients, daycares above state-licensed threshold.
Operating a home business outside Sec. 21-211 standards is a Ch. 21 zoning violation. Code Compliance can issue cease-and-desist notices and Special Magistrate fines up to $250/day; the Building Division can refuse to renew the BTR.
