Unincorporated Mariposa County allows home-based businesses chiefly through two zoning uses: Home Enterprises (Code 17.108.070) and Rural Home Industry (Code 17.108.080). Both are permitted in many zones, but the operator must reside on the property and the use must not become a nuisance.
Because all of Mariposa County is unincorporated, the County's Title 17 Zoning Ordinance governs home businesses everywhere. The County's Business Startup guidance points to two municipal code sections: 17.108.070 (Home Enterprises) and 17.108.080 (Rural Home Industry). Per the County Planning FAQ and code, a Rural Home Industry under Section 17.108.080 is a permitted use unless it is detrimental to the surrounding area by reason of appearance, noise, dust, smoke, or odor; the use must be operated by the owner of the business, who must reside on the property on a permanent basis. The section also contains special setback requirements and nuisance provisions that apply to the ongoing operation. Home enterprises and rural home industry are also expressly listed as permitted uses in the Agriculture Exclusive (AE) zone under Section 17.40.010. The County does NOT require a general business license countywide. The Planning Department cannot formally pre-approve or deny a rural home industry before it operates, but if complaints arise the Planning Director or Board of Supervisors may require operational modifications or cessation. Property owners should use the County's Zoning Lookup Tool and contact Planning (209-966-5151, planning@mariposacounty.org) to confirm their parcel's zone and applicable standards before starting.
A home business that becomes detrimental to neighbors (noise, dust, smoke, odor, traffic, or appearance) or that violates the setback/nuisance provisions of 17.108.080 may be required to modify operations or cease entirely by order of the Planning Director or Board of Supervisors following complaints.
