Houston is the only major US city without zoning. Home businesses are governed by deed restrictions, HOA rules, and general nuisance ordinances. Chapter 10, Article XV authorizes the city to enforce deed restriction violations by injunction.
Houston is unique among major American cities in having no zoning ordinance. Home businesses are not regulated through zoning districts but through deed restrictions, HOA covenants, and general nuisance laws. Chapter 10, Article XV (Sections 10-551 through 10-555) authorizes the City of Houston to enforce deed restrictions by suit for injunction under Texas Local Government Code Chapter 212. The Houston Legal Department handles deed restriction complaints via the hotline at 832-393-6333. In neighborhoods without deed restrictions, home businesses have significantly more latitude. Business licenses and sales tax permits may still be required regardless of deed restrictions. The city produces an annual No Zoning Letter for documentary purposes.
Deed restriction violations: civil injunction through Houston Legal Department. Nuisance complaints: $200 to $500 per violation. Building and fire code violations: correction notice and fines.
