Tomball's zoning ordinance (Chapter 30) permits home occupations as accessory uses in residential districts including R-1, R-2, and R-3 zones. The home occupation must be clearly incidental and secondary to the residential use of the dwelling. The business must be conducted entirely within the enclosed living area of the home and must not occupy more than 25% of the total floor area. No exterior alterations or visible evidence of the business is permitted from the street. The business must not generate pedestrian or vehicular traffic beyond what is normal for a residential neighborhood. No employees other than residents of the dwelling may work on-site. Storage of materials, equipment, or inventory must be completely inside the dwelling with no outdoor storage. The business must not create noise, vibration, smoke, dust, odor, glare, or electrical interference detectable beyond the property line. Prohibited home occupations include auto repair, welding, commercial vehicle storage, and any activity requiring a commercial building permit. Professional services such as consulting, accounting, graphic design, and similar office-based work are generally permitted. Instructional activities such as music lessons or tutoring may be allowed with limitations on the number of students present at one time.
Operating a home business in violation of zoning conditions may result in a cease-and-desist notice from code enforcement. Continued violations carry fines up to $500 per offense per day. The city may seek injunctive relief through the courts to halt unpermitted commercial activity in residential zones.
