Florida law (FS 559.955) protects home-based businesses statewide: Lake County may not prohibit, restrict, or zone a home-based business differently from other businesses, so long as the business stays secondary to residential use and looks like a normal home from the street.
In 2022 Lake County amended its Land Development Regulations to comply with HB 403 / FS 559.955, largely repealing its old home-occupation restrictions. A qualifying home-based business is allowed in any residential zoning district and may not be regulated differently from other businesses. It must be secondary to the property's residential use; employees working on-site must live there, except up to two who do not; parking demand can't exceed what a normal home would generate; and, as viewed from the street, the property must stay consistent with the surrounding residential area. A local government may still enforce noise, parking, and nuisance rules that apply to all residences.
The county cannot ban a compliant home-based business, but may enforce generally applicable nuisance, noise, parking and building rules; a business exceeding those limits can be cited and ordered to comply through code enforcement.
