Marion County LDC Sec. 4.3.1 allows home occupations in residential zoning (within a single-family dwelling, incidental to the residential use) and in agricultural zoning (within the dwelling or an accessory building), each with distinct area limits.
LDC Sec. 4.3.1.A defines a home occupation as a business conducted within a single-family residential dwelling in a residential zoning classification that is clearly incidental to the principal residential use, or conducted on the same tract as the principal structure in an agricultural zoning classification as a permitted use without significantly adverse impact. In residential zones, the area used may not exceed 20 percent of the dwelling's gross floor area or 400 square feet, whichever is less, and the activity may not be conducted in an accessory building. In agricultural zones, the use may occur in the dwelling (same 20 percent / 400 sq ft cap) or in an accessory building not exceeding 600 square feet. The use may not generate more traffic than the allowable residential use.
Operation outside permitted zoning conditions or area limits is a code enforcement violation and grounds for permit revocation by the Board of Adjustment.
