Portions of Mission Viejo along Oso Creek and Trabuco Creek are within FEMA-designated flood hazard zones. Enclosed areas below the BFE must be designed to allow the entry and exit of floodwater through flood vents. Mechanical equipment, electrical panels, and HVAC systems must be elevated above the BFE. The city's building department reviews all construction plans in SFHAs for compliance with floodplain standards prior to issuing building permits. An elevation certificate prepared by a licensed surveyor may be required. Flood insurance is mandatory for properties in SFHAs with federally backed mortgages. Property owners outside SFHAs may still purchase flood insurance at preferred rates. FEMA's Community Rating System (CRS) credits may reduce flood insurance premiums for Mission Viejo residents if the city participates in CRS activities. Building within an SFHA without complying with elevation requirements may result in denial of building permits, stop-work orders, and fines. Non-compliant structures may not qualify for flood insurance or federal disaster assistance. The city may impose administrative penalties for unauthorized fill or construction in flood zones. FEMA may suspend the community's NFIP participation if the city fails to enforce floodplain regulations, which would affect all residents' ability to purchase flood insurance.
