California Health & Safety Code Sections 115920-115929 and California Building Code Section 3109, as enforced in Mission Viejo, mandate pool barriers for all residential swimming pools and spas. Barrier requirements include minimum 60-inch height, maximum 4-inch openings (no passage of a 4-inch sphere), no climbable features on the pool side of the barrier, self-closing and self-latching gates with latches at minimum 54 inches above grade, and gates opening away from the pool. Chain link fences used as pool barriers must have mesh no larger than 1.75 inches. Walls of the dwelling may serve as part of the barrier if all doors and windows providing direct pool access are equipped with approved alarms.
Non-compliant pool barriers result in failed inspections, stop-work orders during construction, and code enforcement citations. The city may require immediate corrective action due to the life-safety nature of pool barriers.
