Under HBMC and HSC §115920-115929, all residential pools must have a primary barrier at least 60 inches high with self-closing, self-latching gates. A secondary barrier is also required. Pool barrier permits are always required regardless of height — unlike standard fences which may be permit-exempt. Yard fencing and access gates must meet city regulations for pool installations. The barrier must have no openings allowing passage of a 4-inch sphere. Gate latches must be at least 60 inches above grade or accessible only from the pool side.
Failure to maintain pool barriers is a safety violation subject to immediate enforcement, fines, and potential pool closure.
