Fullerton enforces California Building Code pool barrier requirements. All residential pools and spas must be enclosed by a barrier at least 60 inches high with self-closing, self-latching gates. Multiple layers of protection are required for new construction.
Under California Building Code Section 3109 and Health & Safety Code Section 115920-115929, all residential swimming pools and spas in Fullerton must have safety barriers. Barriers must be at least 60 inches (5 feet) high with no footholds or handholds that could allow a child to climb. Gates must be self-closing and self-latching with the latch at least 54 inches above grade. For new pool construction, the Swimming Pool Safety Act requires at least two of seven approved safety features: pool fencing, approved safety cover, exit alarms on doors, self-latching devices, pool alarm, removable mesh fencing, or other approved barriers. Existing pools must maintain compliant barriers. The Building Division inspects pool barriers as part of pool permit inspections and during property transactions. The Fullerton Fire Department may also inspect pool barriers during routine fire inspections of multi-family properties.
Non-compliant pool barriers are life-safety violations. The Building Division may issue immediate correction notices. Failure to comply may result in fines, permit revocation, and potential criminal liability if a drowning occurs.
