Costa Mesa enforces California Building Code pool barrier requirements. All residential swimming pools and spas must be enclosed by a fence or barrier at least 5 feet tall with self-closing, self-latching gates to prevent unsupervised child access.
Under California Building Code Section 3109 and Health & Safety Code Section 115920-115929, all residential pools and spas in Costa Mesa must have safety barriers. Barriers must be at least 60 inches (5 feet) tall with no footholds or handholds that could allow a child to climb. Gates must be self-closing and self-latching with the latch at least 54 inches above grade. If the house wall serves as part of the barrier, all doors providing direct access to the pool must have alarms or self-closing mechanisms. Pool covers meeting ASTM F1346 standards may serve as an additional safety layer but do not replace barrier requirements. New pool construction requires barrier installation as part of the building permit process. Costa Mesa Building Safety inspects barriers during pool permit inspections. Existing pools must comply with current barrier standards when property is sold or a building permit is pulled for modifications.
Failure to maintain pool barriers violates California Health & Safety Code and may result in correction notices, fines, and potential liability for drowning incidents. Pool permits may be withheld until barriers comply.
