Newport Beach enforces swimming pool barrier requirements under the California Building Code and Health and Safety Code Section 115920 et seq. All residential swimming pools and spas must be enclosed by a barrier at least 60 inches (5 feet) in height. Gates must be self-closing and self-latching, with the latch mechanism located at least 54 inches above the ground on the pool side. The barrier must not have openings, handholds, or footholds that would allow a small child to climb through or over. Horizontal rails or decorative elements that could serve as footholds are prohibited on the exterior side. In addition to the barrier, at least one additional approved safety feature is required: an approved safety pool cover meeting ASTM F1346, exit alarms on all doors providing direct access to the pool area, or a self-closing and self-latching device on doors and windows providing pool access. For homes with direct indoor access to the pool area, doors must be equipped with alarms or self-closing/self-latching mechanisms. Pool barrier requirements apply to new construction, remodels, and when properties change ownership. The Newport Beach Building Division inspects pool barriers during the building permit process and during property resale inspections.
