Newport Beach does not impose an annual night cap on permitted short-term rentals but restricts which properties may obtain permits. The city limits total STR permits and has geographic concentration restrictions to manage neighborhood impacts.
NBMC Chapter 5.95 governs short-term lodging permits. While Newport Beach does not set a maximum number of rental nights per year, the city controls STR activity through permit issuance limits and geographic restrictions. Permits are limited to specific zoning districts and are subject to density caps in certain areas, particularly Balboa Peninsula and Balboa Island where STR concentration has historically been highest. The city may impose a moratorium or cap on new permits when density thresholds are reached in a given area. Permits are non-transferable and tied to the specific property and operator. Annual renewal is required with compliance review. Operators must maintain a local contact available 24/7 within 30 minutes of the property. Community Development manages permits at (949) 644-3200.
Operating without a valid permit carries administrative fines starting at $1,000. Failure to renew by the deadline requires a new application. Permit transfers upon property sale are not automatic and require new application.
