Louisiana requires public contractors and certain private employers to verify employee work authorization through E-Verify or retain documentation under state law.
La. R.S. 38:2212.10 requires every private employer bidding on or performing public contracts in Louisiana to either participate in the federal E-Verify program or retain copies of specified work authorization documents for each employee for the duration of employment plus three years. La. R.S. 23:995 extends similar verification duties to private employers more broadly, allowing E-Verify enrollment as a safe harbor against unauthorized-employment claims. Failure to comply can disqualify contractors from bidding and trigger administrative penalties. The framework preempts conflicting local employment-verification ordinances.
Noncompliant contractors may be disqualified from public contracts, face contract cancellation, and incur civil penalties; repeat violations can result in suspension from public bidding under state procurement law.
