Vermont does not require private employers to use the federal E-Verify employment verification system, and Burlington has no separate municipal mandate. E-Verify use is voluntary except for some federal contractors and grant recipients.
Unlike states such as Arizona or Mississippi, Vermont has not enacted a statewide E-Verify mandate, and Burlington has not adopted one at the city level consistent with its sanctuary stance. Federal law continues to require all employers to complete Form I-9 employment eligibility verification, but participation in the electronic E-Verify system remains voluntary in Vermont. Federal contractors meeting threshold requirements under the FAR E-Verify clause must enroll, and certain grant recipients may face conditions, but no general Vermont or Burlington requirement applies.
Form I-9 violations are enforced by US Immigration and Customs Enforcement Homeland Security Investigations with civil fines per worker. Vermont Attorney General does not separately enforce E-Verify rules absent fraud.
