Vermont Act 69 of 2019 banned expanded polystyrene foam food service containers statewide effective July 1, 2020. The prohibition covers cups, plates, bowls, trays, clamshells, and other containers used to serve or package prepared food. Burlington food service establishments, including those on Church Street and around UVM, must transition to paper, compostable, or recyclable alternatives. The ban applies to both dine-in and takeout. Pre-packaged food sold in foam containers by manufacturers is exempt. The Vermont Attorney General enforces compliance through inspections and complaint follow-up.
Food service operators using prohibited polystyrene containers face civil penalties enforced by the Vermont Attorney General and may be ordered to switch suppliers immediately.
