Virginia requires state agencies and many public contractors to use the federal E-Verify system under Va. Code Section 40.1-11.5, and Virginia Beach extends this to most city contracts and vendors performing construction or service work for the municipality.
State law mandates that every state agency, every public body, and every employer of more than 50 employees that holds a Virginia state contract worth $50,000 or more enroll in the federal E-Verify electronic employment eligibility verification program. Virginia Beach applies the same standard to city procurement contracts and construction projects in the Resort Area, NAS Oceana support work, and capital improvement program jobs. Subcontractors typically must certify enrollment as well. Private employers not under public contract are not mandated, but many large employers in tourism and defense voluntarily participate. Failure to enroll can disqualify a vendor from future bids.
Noncompliant contractors face debarment from state contracts for up to one year, contract termination, financial penalties, and referral to the Virginia Attorney General for enforcement action.
